Rules of conduct and use of the complex

INTRODUCTION & LEGAL FRAMEWORK

These Rules of Conduct (hereinafter the “Rules”) govern the relationship between “thetube I.K.E.” (hereinafter the “Company”) and any individual or legal entity utilizing the facilities, services, or infrastructure of the workspace complex located at 70 Agias Paraskevis st., Chalandri (P.C. 152 32). The Rules operate as an integral and binding component of the wider Service Agreement (the “Agreement”), which defines the terms under which access and use rights are granted. In the event of conflict between these Rules and the Agreement, the Agreement shall prevail. The Company reserves the right to update, revise, or supplement these Rules when operational, legal, safety-related, or regulatory needs arise. Users shall be informed of any amendments through written or electronic notice.

DEFINITIONS & SCOPE OF APPLICATION

For purposes of clarity and legal precision, the following categories are recognized:

A Customer is defined as an individual who accesses one or more areas of the Complex occasionally and exclusively during staffed hours, without holding a standing contractual agreement.

A Member is defined as a User who has entered into a recurring service arrangement and is thereby permitted to access the Complex during regular staff presence.

A Member Plus is a User whose agreement specifically grants autonomous access beyond staffed hours, including evenings, weekends, and holidays, subject to the technical and safety restrictions outlined herein.

A Guest refers to a private individual who is invited by a User, whose entry is contingent upon prior written approval by the Company, and whose presence is permitted solely under the physical supervision of the hosting User.

A Business Address User is a User entitled, through a lease agreement, to employ a certain part of the Complex as an official business, tax, or legal address.

Unless otherwise expressly stated, these Rules apply equally to all categories of Users.

ACCESS & USE OF FACILITIES

Access to the Complex is dependent upon the category of User and the terms mutually agreed upon.

Member Plus Users may enter the agreed workspace at any hour of the day, throughout the year, except during periods of emergency closure, building-level restrictions, maintenance procedures or government restrictions apply (of which the Member will be notified by the Company).

All other Users are permitted entry strictly during staffed hours, typically from 09:00 to 18:00, Monday through Friday, unless alternative arrangements have been expressly authorized through the Service Agreements.

The Company reserves the right to suspend access temporarily in cases where outstanding fees exist, where breaches of contract or safety obligations are identified, or where security concerns necessitate such action. Suspension shall be proportionate to the circumstances and communicated when reasonably feasible.

Meeting rooms, private offices, and event spaces are available only by reservation. Their use is subject to availability and may incur additional fees. The common workspace areas are intended solely for individual professional use; thus, meetings, collaborative sessions, or guest visits are expressly forbidden unless conducted in designated rooms.

SECURITY, IDENTIFICATION & ACCESS CONTROL

All keys, cards, digital access permissions, and any physical or electronic method of entry remain permanent property of the Company. Users are strictly prohibited from copying, duplicating, lending, or otherwise transferring these access credentials. Any loss or theft must be reported immediately, and replacement charges may be applied.

Prior to issuing access credentials, the Company verifies the identity of each User by means of an official identification document. This process is conducted pursuant to GDPR requirements and legitimate security interests. Personal data obtained during this process is retained only as long as strictly necessary.

Users accessing the premises outside staffed hours bear full responsibility for the security of the areas they enter. They must ensure that all entry points are closed and secured when exiting, and they may be held liable for damages, losses, or safety incidents resulting from failure to comply.

PERMITTED & PROHIBITED USE

The Complex is intended exclusively for legal, professional, administrative, and intellectual work. No User may engage in activities that involve the storage of goods or inventory, food preparation, mechanical work, manufacturing, or any operation producing noise, odors, hazards, or waste. No modification, decoration, affixture, or installation of equipment may be undertaken without the Company’s written approval.

Sleeping on the premises, using furniture for rest, or remaining overnight without authorization is explicitly forbidden. The Company reserves the right to remove any User engaging in such conduct.

EQUIPMENT, FURNITURE & DAMAGE LIABILITY

Users are entitled to use the furniture, fittings, and shared equipment provided by the Company, provided such use is proper, careful, and consistent with intended function. Any damage resulting from negligence, misuse, unauthorized modification, or inappropriate installation will be the financial responsibility of the offending User.

The Company assumes no liability for personal property, equipment, or devices brought onto the premises, and Users are strongly advised to maintain appropriate insurance coverage for laptops, mobile devices, prototypes, or materials stored or used on site.

No User may introduce heaters, cooking appliances, independent refrigeration units, audio amplification machinery, vending equipment, or any other high-consumption or fire-risk device without the Company’s prior written approval. The User will be liable for any damage that may arise from such devices.

PROHIBITION OF WEAPONS & HAZARDOUS MATERIALS

Weapons, ammunition, explosive devices, flammable substances, chemicals, and any other objects or materials deemed dangerous are strictly forbidden. Any violation of this provision shall result in immediate termination of access, without refund, and may be reported to competent legal authorities.

USE OF COMPANY NAME & BUSINESS ADDRESS

Users are not permitted to employ the name, trade identity, or logo of “thetube I.K.E.” in any promotional, commercial, representational, or implied manner without express written authorization.

Business Address Users are expressly permitted to register the Complex as their legal or tax seat, or for inclusion in Business Registry filings, provided this use complies with all applicable laws and does not suggest shared ownership, affiliation, or partnership with the Company.

PROFESSIONAL CONDUCT, NOISE, CLEANLINESS & COMMUNITY OBLIGATIONS

All Users are expected to behave with courtesy, professionalism, and respect toward others. Excessive noise, disruptive behavior, harassment, discrimination, threats, or any form of verbal or physical aggression shall not be tolerated.

Workstations must be kept clean and free of waste. The accumulation of food containers, organic refuse, biological substances, or materials capable of attracting pests constitutes a breach of these Rules.

Smoking and vaping of any kind are strictly prohibited inside the Complex. Alcohol consumption is allowed only when expressly authorized by the Company for official events.

Any act of violence or harassment shall trigger immediate expulsion and permanent denial of future access, without refund.

HEALTH & SAFETY OBLIGATIONS

All Users must comply with applicable health, safety, and fire protection regulations. Evacuation routes and emergency instructions must be followed at all times. If a User anticipates multiple visitors, exceeding normal occupancy, they must notify the Company in advance. The Company may require the reservation of additional space to ensure safety compliance.

HYBRID OCCUPANCY & MULTIPLE USER ACCESS

Where permitted, hybrid use of a dedicated workstation may involve more than one registered User, provided these individuals are identified to the Company, verified for access, and covered for insurance purposes. Under no circumstances may the number of present Users exceed the workstation or office capacity stated in the Agreement. Additional Users are subject to supplementary fees.

SPECIAL REQUESTS & OPERATIONAL EXCEPTIONS

The Company may, at its discretion, accommodate special operational needs submitted by Users. However, no accommodation shall be deemed permanent or contractually binding unless expressly confirmed in writing.

FAIR USE OF AMENITIES

Where provided, complimentary refreshments and utilities are offered as a courtesy and must be consumed in a reasonable and non-abusive manner. Coffee, tea, snacks, filtered water, and printing are intended solely for on-site professional use and not for bulk removal, personal stocking, or external distribution.

The Company may restrict or suspend access to these services in cases of misuse.

MAIL & PACKAGE HANDLING

Mail and package handling services are available only to Users whose agreement includes such provision. The Company shall accept standard mail and parcels up to a defined physical threshold [weighing no more than 4.5 kg (10 lbs), 46 cm (18 inches) on each side, and a maximum volume of 0.03 cubic meters (1 cubic foot)]. Items exceeding the limit, or containing prohibited materials, may be declined. Any package whose content is in doubt will not be accepted from the courier by the Complex staff. Each package received is held for a maximum of fourteen (14) calendar days, after which it may be returned or redirected at the User’s expense. It can be agreed that the package may be held for more than fourteen (14) calendar days, subject to fees. The Company may also be entitled to fees, in the event of excessive amount of mail being received and processed by the company’s staff on behalf of the user. These fees are intended to offset the additional costs associated with storing and managing a volume of mail that exceeds normal usage.

Users that do not have a lease agreement of a Registered Office in the Complex, cannot receive packages in the premises, except they receive them in person in the exact time they are delivered. In other case, the received packages will be transferred to a logistics center of the company’s choosing on the same day they are received. Τhe User will be charged a reasonable one-time fee for such transfer, plus a daily fee for storing and managing any package that is not collected. The cost of storing a package and managing mail is 10 EURO per day.

The Company bears no liability for loss, delay, damage, or mis deliveries except in cases of proven gross negligence.

KYC & COMPLIANCE REQUIREMENTS

In certain cases, local law may require the Company to collect identification data or corporate documentation. The Company may refuse to activate or continue services until such information is received and verified.

PARKING TERMS

Parking facilities, if available, are governed by separate written rules and require additional payment. Unauthorized vehicles may be removed at the User’s expense.

INVOICING DISPUTES & PAYMENT OBLIGATIONS

If a User disputes a charge, they must notify the Company in writing immediately. The burden of demonstrating error lies with the User. If an error is confirmed, correction shall be issued promptly. If not, the amount remains due in full.

Failure to pay may result in restricted access, suspension of services, or legal recovery measures.

COMPANY NAME CHANGE FOR BILLING

Requests to modify invoice details must be submitted in writing, accompanied by necessary documentation. Changes take effect only from the next issued invoice.

DUTY TO MAINTAIN UPDATED CONTACT INFORMATION

Users must ensure that the Company always holds accurate and current contact details, including email, telephone, and invoicing data.

SUBORDINATION OF CONTRACTUAL RIGHTS

These Rules and the Agreement are subordinate to the Company’s own lease and any superior landlord agreements. In any conflict, those documents prevail.

LIABILITY, INSURANCE & RISK ALLOCATION

The Company bears no responsibility for loss, theft, corruption of data, or business interruption experienced by any User. Users are strongly advised to maintain adequate insurance coverage for their property, business equipment, and digital assets.

The Company shall only be liable for damages in cases of proven gross negligence or deliberate misconduct. Under no circumstance shall liability extend to indirect or consequential damages such as lost profits, reputational loss, or operational downtime.

INDEMNIFICATION DUTY

Users agree to indemnify, defend, and hold harmless the Company from any claim, damage, legal cost, or liability arising from their activities, misconduct, contract breach, or unauthorized behavior, including that of their Guests.

TERMINATION FOR CAUSE

The Company reserves the right to terminate access immediately, without refund, in the event of:

  • Illegal activity
  • Violation of safety standards
  • Threatening, violent, or abusive behavior
  • Repeated or serious breach of these Rules or the Agreement

Such termination may be accompanied by notification to legal authorities.

FORCE MAJEURE

Neither party shall be held liable for delays or disruptions resulting from events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Infrastructure failures
  • Public emergencies
  • Interruption of utilities or essential services

GOVERNING LAW & JURISDICTION

These Rules are governed by Greek law. Any dispute arising in connection with them shall fall within the exclusive jurisdiction of the Courts of Athens.

ANNEX A – CONTRACTUAL NATURE & RESPONSIBILITIES

This Agreement is a service license and not a lease; no tenancy rights or possession rights are conferred. The User remains fully responsible for the conduct of associates, employees, contractors, or guests accessing the premises on their behalf.

If payments fall into arrears, the Company may restrict access, suspend services, or pursue recovery through lawful means.

ANNEX B – GDPR & CCTV COMPLIANCE NOTICE

The Data Controller is “thetube I.K.E.”, 70 Agias Paraskevis st., Chalandri. The Company operates CCTV systems for the protection of persons and property, and for the prevention of unlawful acts. The lawful basis is legitimate interest under GDPR Article 6(1)(f).

Cameras monitor entrances, exits, shared spaces, and circulation areas but never private offices or restrooms. Recordings are retained for up to ten (10) days unless required for investigation. Access is restricted to trained personnel, except where footage must be shared with police or judicial authorities.

Data subjects maintain rights of access, restriction, and erasure, subject to legal limitations. Requests may be directed to: gdpr@thetube.gr. Complaints may also be filed with the Hellenic Data Protection Authority (HDPA).
